Kolkata, March 26: Uncertainty continues to cloud the electoral prospects of Swapna Barman, who has been nominated by the All India Trinamool Congress (TMC) for the Rajganj Assembly constituency in West Bengal’s Jalpaiguri district. The development comes amid an ongoing disciplinary case against her during her tenure with the Railways.

The issue has now reached the Calcutta High Court, where proceedings are underway regarding her compliance with service rules and eligibility to contest elections.

Barman, who joined the Trinamool Congress on February 27, was announced as the party’s candidate soon after. However, she had not formally resigned from her position with the Railways at the time of entering active politics.

On March 9, the Railways initiated a departmental inquiry against her, alleging violation of service rules, which prohibit employees from participating in political activities without prior resignation.

Although she submitted her resignation on March 16, it was not accepted due to the ongoing inquiry. This refusal has become a key obstacle in her electoral bid.


Court Proceedings and Directives

The matter was heard at the Jalpaiguri Circuit Bench of the Calcutta High Court before Justice Gourang Kanth.

During the hearing, the Railways informed the court that a clearance certificate—mandatory for contesting elections—could not be issued while disciplinary proceedings were pending.

The Railways stated that such clearance could only be considered if Barman formally acknowledged misconduct and agreed to forgo any post-retirement benefits.

The court subsequently directed her to submit a written admission of misconduct by a specified deadline. While Barman did submit a letter, it was reportedly deemed inadequate by the authorities.

Following this, the court instructed her to file a revised letter explicitly addressing the concerns raised.


Official Position

Representing the Railways, Deputy Solicitor General Sudipto Majumdar informed the court that the departmental inquiry must be resolved before any administrative clearance can be granted.

The Railways maintained that adherence to service rules is essential, particularly in cases involving political participation by serving employees.
